Cuando la autoridad penal profiera sobreseimiento definitivo o sentencia absolutoria debidamente ejecutoriada en favor del suspendido, éste tendrá derecho a que se le reconozcan los salarios y prestaciones dejados de percibir durante el período de la suspensión.
