º . Si los bienes inmuebles se encuentran en condiciones aceptables de funcionamiento y los escenarios del mercado permiten presumir la viabilidad del proyecto a desarrollar, la Empresa Social del Estado podrá preferir entregarlos en comodato u otras figuras jurídicas para la prestación de servicios de salud, a personas jurídicas solidarias sin ánimo de lucro constituidas por sus ex funcionarios o de las que estos hagan parte.
