Si el empleado que descubriere o tuviere noticia de la infracción no fuere funcionario de instrucción, dará el correspondiente aviso a uno que lo sea, prefiriendo en todo caso a los Jefes de Aduana, y participando lo ocurrido al Gobernador del Departamento para que por medio de sus agentes ejerza la vigilancia sobre los funcionarios que deban instruír el sumario y conocer de la causa.
