Art. 328. Si no se apelare oportunamente de la sentencia, se declarará ejecutoriada y se dispondrá lo conveniente para su ejecución; pero si el reo estuviere en libertad ó excarcelado bajo fianza, no se declarará ejecutoriada la sentencia, mientras no se le notifique á él en persona, y entretanto conserva su derecho para apelar del fallo que lo condena.
