Las armas, los instrumentos o utensilios con que se haya ejecutado un delito, y los efectos en que ésta consista, o que formen el cuerpo del él, se aplicarán al Estado, a no ser que la sentencia disponga que se destruya, o que se devuelvan a un tercero a quien se hubieren robado o sustraído, o que sin culpa suya se haya usado de ellos para cometer el delito.
