Para los efectos del artículo anterior, quien pretenda actuar así ante el Ministerio de Trabajo y Seguridad Social deberá acreditar ante el funcionario del conocimiento que la organización sindical que representa goza de personería jurídica vigente, y que la persona en cuestión se encuentra inscrita como miembro de la junta directiva de la respectiva federación o confederación, mediante constancia expedida por el secretario general de la una o de la otra.
