Cuando aprehendidos los efectos de algún contrabando y hecho el sumario correspondiente, no hubieren sido descubiertos los autores, cómplices y encubridores del delito, se pasará el sumario al Juez competente, si no lo fuere el que lo instruyo, después de verificado el remate de los efectos aprehendidos.
