º . Obligaciones contingentes. Para los efectos de la Ley 448 de 1998, y en los términos de la misma, son obligaciones contingentes las que se pactan explícitamente en los contratos de las entidades estatales para garantizar el pago de una suma de dinero por la ocurrencia de un determinado hecho futuro e incierto, previsto expresamente en el contrato, con efectos sobre el flujo financiero derivado del contrato y que se asumen en virtud del mismo por la entidad estatal contratante como pérdidas.
