En cada Brigada o unidad operativa y en, las Fuerzas Aéreas y Armada Nacional, debe haber un funcionario de instrucción y un fiscal, permanentes. El Tribunal Militar de que trata el artículo 21 de este Código tiene un fiscal de carácter permanente que debe ser abogado graduado. El Juez de que trata el artículo 13 también tiene carácter de funcionario de instrucción.
