Art. 23. Lo dispuesto en el artículo 307 del Código Judicial es aplicable al caso en que el menor tenga necesidad de comparecer en juicio en contra de su padre ó de guardador. En el caso que el hijo pretenda demandar al padre, al nombramiento de curador ad liten precederá licencia judicial para comparecer como actor. Cuando en juicio universal el padre del menor sea por si interesado en la causa, no podrá representar al hijo, á quien se nombrara curador ad liten como se dispone en el citado Artículo.
