El artículo 40 del Decreto - ley 955 de 1970 queda así: Artículo 40. Excarcelación. Hay lugar a excarcelación en todos los casos en que la pena señalada para el delito sea de arresto, y en los delitos sancionados con pena de prisión, cuando el valor del contrabando sea inferior a cincuenta mil pesos.
