Para apreciar el testimonio, el juez tendrá en cuenta los principios de la sana crítica y especialmente lo relacionado con las circunstancias en que se llevó a cabo la percepción, la capacidad del testigo para la conservación del recuerdo, el transcurso del tiempo y las demás circunstancias que afecten la evocación de lo percibido, así como la personalidad del declarante y la forma en que hubiere declarado.
