° Las actas elaboradas de conformidad con lo previsto en el artículo anterior solo se agregarán al proceso cuando el Ministro de Justicia certifique por escrito al Juzgado de conocimiento que se han adoptado las medidas especiales consagradas en el artículo 4° del Decreto legislativo 1199 de 1987, respecto del testigo. Para el efecto, la apertura de los sobres se cumplirá con la asistencia del Agente del Ministerio Público, previa certificación sobre el estado de los mismos, de lo cual se dejará constancia escrita.
