Art. 166. Si el Juez concediere uno de los recursos de que trata el artículo anterior, sin que el recurrente haya pagado las costas, el Superio se abstendrá de conocer, á petición de la parte contraria, y ordenará que se devuelva la actuación al Juzgado de su procedencia, sin perjuicio de disponer lo conveniente para hacer efectiva la responsabilidad en que hubiere incurrido el Juez.
