Los nombramiento de los Jueces Superiores y de Circuito tanto principales como suplentes corresponde a los Tribunales Superiores en Sala de Acuerdo. También corresponde a los Tribunales declarar la vacante en cualquiera de los casos del artículo 5º de la Ley 147 de 1888 y en los primeros números del artículo 6º de la misma ley.

Parágrafo

Los suplentes de los Jueces no necesitan acreditar los requisitos de que trata el artículo 2º de la citada Ley para posesionarse y ejercer las funciones de Juez.
