De la solicitud para que se conceda la libertad provisional se dará traslado al Agente del Ministerio Público por el término de cuarenta y ocho horas, para que emita concepto en lo relativo a la excarcelación y a la caución ofrecida.

Contestado el traslado por el Ministerio Público, se resolverá la solicitud dentro de cuarenta y ocho horas; pero podrá aplazarse el fallo hasta por cinco días sin suspender la investigación, cuando hubiere necesidad de allegar pruebas para saber si la infracción está comprendida entre las que admiten excarcelación.
