º Cuando se compruebe que el consumidor pagó un precio superior al indicado a la lista de precios o al que aparece marcado en el bien, además de ordenarse el reintegro de las sumas pagadas en exceso y de imponer las sanciones pertinentes, el funcionario que conoció del hecho deberá, si es el caso, hacer la correspondiente denuncia penal.
