Beneficio de competencia. Durante el término de: ejecutoria del auto de traslado del avalúo o del que rechace su objeción, si fuere el caso, el ejecutado podrá invocar el beneficio de competencia, y su solicitud se tramitará como incidente, en el cual aquel deberá probar que los bienes avaluados son su único patrimonio. Si le fuere reconocido, en el mismo auto se determinarán los bienes que deben dejársele para su modesta subsistencia, teniendo en cuenta lo dispuesto en el inciso segundo del artículo precedente, y se ordenará su desembargo.
