Mientras el Superintendente se halle en posesión del activo y negocios del establecimiento bancario, podrá en cualquier tiempo, dentro de los seis años siguientes a la iniciación del procedimiento judicial, promover y adelantar en su nombre cualesquiera acciones que tenga el establecimiento bancario, sus accionistas o acreedores, contra los directores, gerentes o funcionarios de éste.
