Las minas de que trata el ordinal 3º del artículo 202 de la Constitución, excepto las de esmeraldas, y aquéllas a que se refiere el aparte b del artículo 4º de este Código, son denunciables por personas naturales o jurídicas, y explotables por ellas, en los términos y dentro de los límites señalados por el Código de Minas y las leyes que lo adicionan y reforman.
