ARTICULO 2.1.3.1.9 .- NATURALEZA DE LAS OBLIGACIONES Y RESPONSABILIDADES DEL FIDUCIARIO. Dentro de los contratos mediante los cuales se vincule a los constituyentes o adherentes con los fondos o proyectos específicos de invasión deberá destacarse la circunstancia de que las obligaciones que asume el fiduciario tienen el carácter de obligaciones de medio y no de resultado. En consecuencia, las sociedades fiduciarias se abstendrán de garantizar, por cualquier medio, una tasa fija para los recursos recibidos, así como de asegurar rendimientos por valorización de los activos que integran los fondos.
