Las resoluciones definitivas dictadas por el Ministerio de Educación podrán ser acusadas ante el Consejo de Estado, dentro de los treinta días siguientes a la fecha en que quede agotada la vía gubernativa. Estas acciones se tramitaran por el Consejo de Estado en la siguiente forma: Repartido el expediente, el Consejero a quien le corresponda, ordenará se fije en lista el asunto, por el término de cuatro días, previo traslado al respectivo agente del Ministerio Público, por igual término; vencido el término de fijación en la lista, durante el cual el interesado podrá presentar los alegatos del caso, el mismo Consejero decidirá de la acción.
