Para que un empleado público nacional pueda recibir el beneficio de jubilación, se requiere que reintegre o compense las sumas que haya recibido a título de cesantía.

Parágrafo

Ningún pensionado podrá ser empleado público, a menos que desista de recibir la pensión de jubilación durante el tiempo en que este devengado como empleado público.
