En los testamentos privilegiados podrá servir de testigo toda persona de sano juicio, hombre o mujer, mayor de diez i ocho años, que vea, oiga i entienda al testador, i que no tenga la inhabilidad designada en el número 8o. del artículo 1068. Se requerirá, además, para los testamentos privilegiados escritos, que los testigos sepan leer i escribir.

Bastará la habilidad putativa con arreglo a lo prevenido en el artículo 1069.
