- Prohibición de despido

Ninguna empleada oficial podrá ser despedida por motivo de embarazo o lactancia.

Durante el embarazo y los tres (3) meses subsiguientes a la fecha del parto o aborto, solamente podrá efectuarse el retiro de la empleada por justa causa comprobada y mediante la autorización expresa que al efecto deberá solicitarse del respectivo inspector del trabajo, cuando se trate de trabajadoras vinculadas por contrato de trabajo. Si la empleada oficial estuviere vinculada por una relación de derecho público, se requerirá para tal efecto resolución motivada de la correspondiente entidad nominadora
