Art. 10. La utilidad imaginaria o la comisión no se considerarán incluídas en el seguro de mercaderías, sino cuando se hubiere estipulado expresamente en la póliza: en este caso, si se hubiere declarado valor asegurable sin expresar qué proporción de tal valor representa la utilidad imaginaria, o si no se hubiere declarado valor asegurable, se considerara asegurado, como utilidad imaginaria el diez por ciento del valor declarado o del valor asegurable (Articulo 8º) según el caso: lo propio sucede con respecto a la comisión con la modificación, sin embargo, de sustituir al diez por ciento el dos por ciento.
