Cuando una tropa destacada o independiente, o en partidas separadas de su base se halle en un lugar en donde no reside el funcionario de instrucción, el respectivo Comandante levantará por si el sumario o lo mandará practicar al Oficial más idóneo que lleve a sus órdenes, pero en ningún caso podrá ser funcionario instructor el Oficial que hubiere sido agraviado con el delito.
