En cada capital de Departamento, excepto en Cundinamarca, en donde actuará el Consejo Nacional, habrá un comité departamental de protección infantil encargado de desarrollar la obra de protección infantil que le sea encomendada por el Consejo Nacional.

Este comité estará integrado por cinco miembros, así: el Director de Educación del Departamento, el Juez de Menores, donde lo hubiere, o en su defecto el Juez de Circuito Penal que designe el Tribunal Superior, uno nombrado por el respectivo ordinario diosesano y dos nombrados por el Consejo Nacional.
