° Declarada la caducidad, la Empresa con sus anexidades, todo debidamente inventariado, pasara a poder del Gobierno; pero se reconocerá á cargo de la misma Empresa á favor del Concesionario ó de quien sus derechos represente, la suma que se compruebe haber sido últimamente invertida en la obra, siempre que los valores representados por tal suma existan en esa época; y que se deduzca a favor del Gobierno el valor que este haya dado por subvención en bonos ó títulos de tierras baldías.
