Los documentos preparatorios, las deliberaciones y las actas del Consejo y el Comité Operativo de Seguridad Nacional, por tratarse de documentos relacionados con la defensa o seguridad nacional, de conformidad con lo señalado en el artículo 12 de la Ley 57 de 1985 serán reservados. Los miembros e invitados del Consejo y el Comité Operativo de Seguridad Nacional que tengan acceso a este tipo de información deberán garantizar la reserva de la misma, so pena de incurrir en las sanciones penales y disciplinarias a las que haya lugar.
