Confesión simple. Confesión simple es la declaración del procesado en la que reconoce el hecho que se le imputa y la propia responsabilidad siempre que reúna las condiciones siguientes:

1. Que sea hecha ante el funcionario compe tente.

2. Que el procesado haya sido informado de los derechos de nombrar defensor, a guardar silencio y que no está obligado a declarar contra sí mismo.

3. Que se haga consciente y voluntariamente.

4. Que no se haya obtenido mediante violencia, fraude o promesa de cualquier índole.
