"ARTICULO 5º

"La Comisión quedará constituída en los meses que sigan a la entrada en vigor del presente Tratado.

"Si dentro de ese plazo no se hicieran los nombramientos de Comisionados que deben designarse en común, o, en caso de reemplazo, dentro de los seis meses siguientes a la vacante del cargo, se rogarán a falta de otro acuerdo, al Presidente de la Corte Permanente de Justicia Internacional o, si éste es natural de uno de los Estados contratantes, al Vicepresidente de la Corte, que proceda a efectuar las designaciones necesarias.
