Los legatarios tienen derecho a pedir que se haga la partición, o pueden solicitar del Juez que, mediante una articulación, ordene que se les paguen inmediatamente sus asignaciones si las fuerzas del patrimonio lo permiten y dan caución de restituir lo que les toque, conforme lo establece el artículo 1431 del Código Civil.
