De la demanda para que se decrete la partición material de la cosa común, o la venta para repartir su producto, se le da traslado al demandado por el término de tres días.

Con la demanda debe presentar el demandante la prueba de que es comunero que, si consiste en un TITULO registrado, ha de ser completada con el certificado del Registrador de instrumentos públicos sobre la suficiencia de él.

En los casos previstos en el artículo 1379 del Código Civil, la demanda debe ir acompañada de la prueba de haberse obtenido la licencia judicial correspondiente.
