En el caso de que por sentencia judicial se declare de propiedad particular la totalidad o parte del subsuelo otorgado en licencia de exploración, en concesión, aporte o permiso, la Nación no estará obligada a indemnización alguna en favor del concesionario o beneficiario, salvo que se demuestre plenamente su acción u omisión dolosas.
