º Para efectos del numeral 1º. del artículo 5º. de la Ley 40 de 1990 la sanción pecuniaria a que se refiere el mismo, se tomará en salarios mínimos legales mensuales, vigentes en la fecha de su aplicación.

Parágrafo

Las sanciones establecidas en el artículo 5º. de la Ley 40 de 1990, serán impuestas por las secretarías o servicios de salud departamentales, o en su defecto por las Alcaldías Municipales.
