Si el demandante pide que el opositor preste caución de pagar los perjuicios que resulten de la oposición, el Juez la decreta y si no se da dentro de seis días, se entiende que desiste de la misma, sin perjuicio de que pueda hacer valer su derecho por la vía ordinaria.
