Art. 8° El papel-moneda emitido legalmente por el antiguo Banco Nacional y por el Gobierno y los Departamentos, continuará conservando su carácter de moneda de curso forzoso y su poder liberatorio, según las reglas siguientes:

1ª Es potestativo en toda clase de contratos ó transacciones civiles y comerciales, ya sean oficiales ó privadas, estipular libremente cualquiera especie de monedas nacionales ó extranjeras de oro; y

2ª En las regiones de la República en que existe como medio circulante la moneda legal de plata, ésta conservará su poder liberatorio al precio en relación con el platón de oro que tenga en el mercado, y podrá estipularse libremente en dicha moneda.
