Será castigado con prisión de veinte días a veinte meses todo funcionario público encargado de la custodia o traslación de una persona detenida o condenada, y todo funcionario investido por razón de sus funciones de cualquier especie de autoridad respecto de es persona, que cometa contra ella actos arbitrarios, o la someta a rigores no autorizados por los reglamentos.
