El funcionario público que, abusando de sus funciones, ordene o cometa en detrimento de alguien un acto arbitrario cualquiera, no clasificado especialmente en la ley penal, será castigado con prisión de diez días a nueve meses.

Con la misma pena se castigará funcionario que, en ejercicio de sus funciones, excite a alguien a desobedecer las leyes o las providencias de la autoridad.
