ART. 1382. Si todos los coasignatarios tuvieren la libre disposición de sus bienes, i concurrieren al acto, podrán hacer la partición por sí mismos, o nombrar de común acuerdo un partidor; i no perjudicarán en este caso las inhabilidades indicadas en el antedicho artículo.

Si no se acordaren en el nombramiento, el Juez, a petición de cualquiera de ellos, nombrará un partidor a su arbitrio, con tal que no sea de los propuestos por las partes, ni albacea, ni coasignatario.
