Art. 38.º Cuando la acción distinguida de valor se haya ejecutado por el General en Jefe del Ejercito, dará directamente parte, con la cita del nombre un numero considerable de testigos caracterizados, al Ministerio de Guerra, para que haciendo este alto funcionario investigar los hechos, por los medios que la ley, la razón y la prudencia lo exijan, venga luego aquélla á noticia del Jefe del Gobierno Ejecutivo, para que él resuelva, como en los demás casos, lo que justamente convenga.
