Conforme a la ley, el Jefe del Resguardo lo es del puerto donde desempeña su cargo y sus funciones están determinadas en el Código Fiscal de 1873, y especificadas algunas en el artículo 406 del mismo, fuera de las que figuran en leyes especiales sobre la materia. Además, le correspondo dictar el reglamento especial sobre el modo más acertado como sus subalternos deben prestar el servicio oficial que les asigne, según la categoría de cada uno.
