El militar que cometiere e) delito de homicidio en la persona del General o jefe supremo de operaciones en campaña, será castigado con la pena de veinticinco años de reclusión militar.

Si el delito se cometiere en la persona de cualquiera otro superior en empleo o mando, la pena será de quince a veinticinco años de reclusión militar, previa degradación o destitución, según los casos.
