Salvo convenio entre las partes, los gastos comunes de la división se distribuyen entre los condueños, a prorrata de sus derechos, y si éstos no los sufragan, debe hacerse un lote en especie o en dinero, según el caso, para que se cubra, o sacarse a remate la parte de bienes necesaria.

El comunero que haga los gastos que corresponden a todos, tiene derecho a que se le reembolse con parte de los bienes comunes o del producto de la venta.
