Art. 174. La falta de citación para sentencia de pregón y remate no induce nulidad: pero en cualquier estado que se presente el ejecutado pueda proponer excepciones y su este caso se suspende el pregón y remate de los bienes.
Si el remate se hubiere verificado, se colocará el dinero á interés en la persona designada en el artículo 221, exigiéndose del acreedor, si ya se le hubiere entregado.
