En los casos a que se refiere el artículo 39 del Decreto 2804 de 1975 y mientras se constituyen organismos ejecutores que presten los servicios, el Instituto Nacional de Salud podrá hacerse cargo de prestarlos, siempre que asuma la administración de la respectiva empresa. A tiempo de la entrega se levantará un acta que suscribirán el Director del Instituto Nacional de Fomento Municipal, el del Instituto Nacional de Salud o quienes ellos autoricen y el Gerente del organismo ejecutor, si este ya se hubiere constituido. En el acta de entrega se expresarán los valores que lo bienes tengan en los libros.
