El auto de proceder es apelable en el efecto suspensivo en el acto de la notificación ó dentro de las veinticuatro horas de notificado para ante el Tribunal respectivo. El Tribunal, previa fijación del negocio en lista, por cuarenta y ocho horas, para que las partes aleguen por escrito, decidirá el recurso dentro de tres días improrrogables.
