º Auto inhibitorio. El Jefe de la dependencia investigadora se abstendrá de abrir investigación disciplinaria cuando aparezca que el hecho no ha existido, o que no está previsto en la ley como infracción o que la acción disciplinaria no puede iniciarse o se ha extinguido. Tal decisión se tomará mediante providencia contra la cual no procede recurso alguno.
