Artículo 38. Ingreso Y Formación

Ley 1709 de 2014 · por medio de la cual se reforman algunos artículos de la Ley 65 de 1993, de la Ley 599 de 2000, de la Ley 55 de 1985 y se dictan otras disposiciones.

amends Artículo 38 LEY 65 de 1993

Modifícase el artículo 38 de la Ley 65 de 1993 , el cual quedará así:

Artículo 38. Ingreso y formación. Para ejercer funciones de custodia y vigilancia penitenciaria y carcelaria es necesario haber aprobado los cursos de formación y capacitación que para este efecto dictará la Escuela Penitenciaria Nacional.

Los Directores de los Establecimientos Penitenciarios y Carcelarios serán de libre nombramiento y remoción. Para desempeñar el cargo de Director de cárcel o penitenciaría se requerirá título universitario en áreas que incluyan conocimientos en materias criminológicas, penales, carcelarias, de seguridad, administrativas o Derechos Humanos. Además, deberá realizar y aprobar el curso que organice la Escuela Penitenciaria Nacional para ocupar dicho cargo.
